Short title

(a) These regulations shall be called the University Grants Commission (Promotion of Equity in Higher Education Institutions) Regulations, 2026 (UIN:1/2026). 

(b) They shall apply to all the higher education institutions in India. 

(c) They shall come into force from the date of their publication in the Official Gazette. 

To eradicate discrimination only on the basis of religion, race, gender, place of birth, caste, or disability, particularly against the members of scheduled castes and scheduled tribes, socially and educationally backward classes, economically weaker sections, persons with disabilities, or any of them, and to promote full equity and inclusion amongst the stakeholders in higher education institutions.

What are the new guidelines:

The University Grants Commission (UGC) has recently released the Promotion of Equity in Higher Education Institutions Regulations, 2026.These rules have been brought in place of the Anti-Discrimination Guidelines of 2012.To be implemented by the University Grants Commission (UGC) in the year 2026, this new law/regulation is a major step towards ensuring equity, inclusion and a discrimination-free environment in India's higher education system.According to the latest update, after hearing the petition challenging the new rules of UGC, the Supreme Court has put a stay on the new rules, the next hearing on this will be on March 19.

Main Points of UGC Bill 2026

  • Aim to eliminate discrimination: To prevent discrimination on the basis of caste, religion, sex, place of birth and disability on campus.
  • Equal Opportunity Centre mandatory: It is necessary to create EOC in every institution.
  • Constitution of Equity Committee: Special committee to investigate and act on complaints.
  • Inclusive representation: Participation of SC, ST, OBC, women and disabled persons is mandatory.
  • Protection to OBCs too: For the first time, along with SCs and STs, OBCs also got clear legal protection.
  • Ombudsperson system: Independent appeal rights if dissatisfied with the institution.
  • Accountability of Institutions: College/University Head directly responsible.
  • Regular Reporting System: Annual report is required to be submitted to UGC.
  • National Monitoring Committee: Monitoring of regulations across the country.
  • Strict punishment: Violation of rules can lead to withdrawal of UGC recognition and schemes.


What will be the procedure if a complaint is received?

An Equity Committee will be formed under the EOC, which will include SC, ST, OBC, women and disabled representatives. Such as exclusion from UGC schemes, prohibition from offering degree programs, discontinuation of open, distance, and online courses, and delisting under the UGC Act. The UGC may also impose additional penalties if necessary.


why is there opposition?

If the rules are not followed, UGC can stop grants, stop new courses and delist the institution.These rules are linked to Articles 14, 15, 16, 17, and 46 of the Constitution. However, critics say the definition of “indirect discrimination” is vague, raising the risk of false complaints and increasing administrative pressure on institutions.
